came to the conclusion that I had received fees in advance in the case of Nam Ly Sing, deceased, from a note in my handwriting as to receipt of payment of money in the file in that ca.Be and he further admitted that he would have come to the same conclusion if he had seen similar notes as to receipt of payment of money in other pauper cases, but that he did not remember seeing any previous to this note in Nam Ly Sing deceased, which is dated the
day of May, 1913.
I respectfully submit that this could not have been either possible or probable. lot less than a hundred of these files must have been placed before him to be passed on to the Chief Justice by him for grants to be made. He admitted that although petition in probate matters are initialled by the Deputy Registrar and Appraiser as correct he looks through them to see if the legal formalities are complied with. He further admitted that the fact that petitions are initial led by the Deputy Registrar and Apprais- -er as correct did not relieve him of the responsibility as the Head of the Department to acquaint himself generally with the facts conected therewith and to see that they were in order as a whole. This being so I would request the Committee to consider with what amount of care lir. Hisbet Lust have scrutinized the Probate files placed before him to be passed on to the Chief Justice and in spite of all that he did not see any full sheet of blue foolscap paper with a note as to receipt of payment of money by ine in any other cases except the case of Nam Ly Ring, deceased, and the last case that I had in the kegistry.
In spite of the fact that he saw me receiving cash from pauper applicants and in spite of the fact that he often saw me in the Registry with half a dozen pauper people investigating and further more in spite of the fact that his suspicions had been aroused in lovember last as is alleged by him by a report from
Mr. Fletcher, the then Deputy Registrar and Appraiser that I was
receiving fees in advance, he never questioned me with regard to
it. When he saye that he subsequent to the report by Mr. Fletcher
spoke to me about it but that he does not remember what took place
